The purpose of this Privacy Policy is to describe how Fika, LLC. (“Fika,” “we,” “our,” or “us”) collects, uses, and shares personal information about you through our website, mobile application, and related photo-sharing and storage services (collectively, the “Services”). As used in this Privacy Policy, “Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify an individual.

By accessing and using our Services, you acknowledge and fully understand this Privacy Policy and freely consent to the information collection and use practices described herein. IF YOU DO NOT CONSENT TO THE INFORMATION COLLECTION AND USE PRACTICES DESCRIBED BELOW, YOU MUST IMMEDIATELY CEASE ANY ACCESS OR USE OF OUR SERVICES.
1. Information Collected
We collect certain information, including Personal Information, from and about you in three ways: (i) directly from you; (ii) automatically via technology; and (iii) from third-parties uploading information about you.
Personal Information We Collect Directly From You
While the Personal Information we collect varies depending upon your use of the Services and our interactions with you, we may collect the following directly from you:

Account and Registration Information. When you create an account, we collect your name, email address, username, password, and date of birth or age. Date of birth or age is collected solely to verify that you meet the minimum age requirements to use the Services and to assign the appropriate account type. We do not use date of birth or age for any other purpose.

Organization Information. For Admin Users, we may collect information about the youth organization you represent, including organization name and type.

Communications and Interactions. When you communicate with us, we collect and maintain a record of your contact details, communications, and our responses.

User Content. We collect photos, videos, captions, and comments you upload or post to the Services (“Content”), which may contain images of minors. Please see Section 6 below for important information about Content containing images of minors.

Responses and Feedback. If you participate in surveys or provide feedback, we collect your responses.
Personal Information We Collect Automatically
We and our third-party service providers automatically collect certain information related to your use of the Services, including through cookies and similar technologies (collectively, “Usage Data”). This may include:

Device and Browsing Information. When you visit the Site or use the App, we may collect your IP address, browser type, operating system, device type, unique device identifier, internet service provider, referring and exiting URLs, and similar information.

Activities and Usage. We collect activity information related to your use of the Services, such as links clicked, features used, photos viewed or downloaded, time spent within the Services, and similar usage information.

Location Information. We may collect or derive location information from you or your IP address.
2. Third-Party Analytics
Google Analytics. We use Google Analytics to help us analyze traffic patterns and improve our Services. Google Analytics uses cookies and similar technologies to collect Usage Data about your interactions with the Services. This information is transmitted to and stored by Google. We use Google Analytics for internal analytics purposes only and do not use Google Analytics or any other service for targeted advertising or interest-based advertising. You may opt out of Google Analytics data collection by installing the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.
No Targeted Advertising. Fika does not engage in targeted or interest-based advertising. We do not sell or share your Personal Information with advertising networks or use your information to serve personalized advertisements. Any analytics data we collect is used solely to understand how our Services are used and to improve them.
3. How Your Information May Be Used and Disclosed
If you submit or we collect Personal Information through our Services, such information may be used in the following ways:

to provide, administer, and improve our Services, including photo storage, sharing, and download functionality;

to create and manage your account, verify your identity and age eligibility, and authenticate your access to the Services;

to communicate with you in connection with your account or your use of the Services;

to protect our rights or property and to ensure the technical functionality and security of our Services; and

as required to meet our legal and regulatory obligations, including obligations related to the protection of minors.
We do not sell, lease, rent, or otherwise disclose your Personal Information to third parties for their own marketing or advertising purposes. We may disclose Personal Information as follows:

Vendors and Service Providers. We may disclose Personal Information to service providers who perform functions on our behalf, such as IT and website hosting, data storage, payment processing, analytics (including Google Analytics), security, and legal counsel. These providers are contractually obligated to use your information only as directed by us.

In the Event of Merger, Sale, or Change of Control. We may transfer or assign Personal Information to an entity that acquires us or our assets or is merged with us as part of a merger, acquisition, sale, or other change of control.

Other Disclosures. We may disclose Personal Information if we have a good-faith belief that disclosure is necessary to: (i) comply with any applicable law, regulation, legal process, or governmental request; (ii) enforce our Terms of Use; (iii) detect, prevent, or address fraud, security, or safety issues; or (iv) protect against harm to the rights, property, or safety of Fika, our users, or others. This includes reporting suspected child sexual abuse material (CSAM) to the National Center for Missing and Exploited Children (NCMEC) and other appropriate authorities.
Aggregate and De-identified Information. We may use, disclose, and otherwise process aggregate and de-identified information for quality control, analytics, research, and development purposes. Such information cannot reasonably be used to identify you.
4. Information Security
No website or application can guarantee absolute security. We utilize commercially reasonable physical, electronic, and procedural safeguards to protect your Personal Information in compliance with applicable law. Access to Personal Information is limited to personnel and service providers who need access to perform their functions.
Given that our Services may involve Content that includes images of minors, we take additional measures to restrict access to Collections only to members of authorized Organizations, as managed by Admin Users. We strongly encourage Admin Users to exercise care in managing Organization membership and promptly removing access for any unauthorized individuals.
5. Third-Party Sites
The Services may contain links to third-party websites and services. This Privacy Policy does not apply when you leave our Services and visit a third-party site. We encourage you to review the privacy policies of any third-party sites you visit, as we are not responsible for their privacy practices.
6. Children and Minors
Children Under 13
Fika’s Services are not directed to children under the age of 13, and children under 13 may not create accounts or directly access, use, or manage the Services. We do not knowingly collect Personal Information directly from children under 13. If you believe we have inadvertently collected Personal Information directly from a child under 13, please contact us immediately using the contact information below and we will use reasonable measures to promptly delete such information.
Photographs of Children Under 13. Our Services are designed for use by organizations, including youth organizations, and accordingly Collections may contain photos and videos that depict individuals under the age of 13. The upload of such Content is subject to the following requirements:

The Admin User or any User uploading Content must obtain the prior consent of the parent or legal guardian of any minor depicted in such Content before uploading.

Any parent, guardian, or other individual may revoke consent at any time by contacting the Admin User or Fika directly.

Upon receipt of a revocation of consent, the Admin User is requested to immediately delete all affected photos and videos from the Collection.

Fika does not use photos or videos depicting minors for any purpose other than providing the Services (i.e., storage, display within the Organization, and download by authorized Users).
Users Between the Ages of 13 and 17
Users between the ages of 13 and 17 (“Minor Users”) may use the Services as Members or Viewers only, and only with the prior consent and ongoing supervision of a parent or legal guardian. By allowing a Minor User to register for or use the Services, the parent or guardian represents and warrants that they have reviewed and agreed to these Terms and this Privacy Policy on behalf of the Minor User.
We encourage parents and guardians to monitor their child’s use of the Services. If you have questions or concerns about a Minor User’s account, please contact us.
7. Communications Opt-Out
We may send certain service-related messages, including account notifications and updates. If we send optional marketing or newsletter communications, all such messages will include instructions on how to opt out. Certain service-related messages (such as account status updates or security alerts) may be required for the functioning of the Services and will not have opt-out capabilities.
8. Information Retention
We retain your Personal Information only as long as necessary to provide you with our Services and for legitimate and essential business purposes, such as maintaining the performance of our Services, complying with our legal obligations, and resolving disputes. We retain your Personal Information for as long as you are a registered user of our Services. Upon account deletion or termination, we will delete or de-identify your Personal Information in accordance with our standard retention schedules, except where retention is required by applicable law.
Content you have uploaded (including photos and videos) will remain on the Service upon termination of your account unless you have previously deleted such Content or unless deletion is restricted by applicable law.
9. Your Privacy Rights
California “Shine the Light.” California residents may request, once per calendar year, a list of the categories of Personal Information we have disclosed to third parties for their direct marketing purposes and the names and addresses of those third parties. We do not share Personal Information with third parties for their direct marketing purposes without your consent.
10. International Visitors
Our Services are intended solely for users located in the United States. If you are accessing the Services from outside the United States, your information may be transferred to, stored, or processed in the United States, where our servers are located. By using our Services, you understand and agree that your information may be transferred to and processed in the United States.
11. Policy Changes
We reserve the right to revise or update this Privacy Policy at any time. We will notify you of any material changes by posting the revised Privacy Policy and its updated effective date on the Site and, where feasible, by providing notice through your registered email address. Your continued use of the Services following notice of such changes constitutes your agreement to and acceptance of the updated Privacy Policy.
